What appeal rights do I have if I’m RIF’d?
If you are separated, downgraded, or furloughed for more than 30 days by RIF, you have the right to appeal to the Merit Systems Protection Board. The appeal must be filed during the 30-day period beginning the day after the effective date of the RIF action. MSPB’s review of agency action is limited to the written record unless MSPB determines that there are facts in dispute.

If you are in a bargaining unit covered by a negotiated grievance procedure that does not exclude RIF actions, you must use the negotiated grievance procedure. You may not appeal to the MSPB unless you allege the action was based upon discriminate¬tion.
