Can I challenge my agency’s decision not to grant a security clearance or to not renew one already in place?
The Merit Systems Protection Board has only limited authority to review personnel actions involving security clearances or sensitive positions in general; essentially, MSPB can review whether the agency properly followed its own policies, but not the reasons behind its decision. However, employees who believe that a decision affecting their eligibility for access to classified information was an act of retaliation for their whistleblowing may challenge the action through an independent procedure, with higher-level review in certain circumstances.

An agency determination that an employee does not have, or no longer has, a need for access to classified information is solely within the employing agency’s discretion.
