Postal group files lawsuit over pay

The National Association of Postal Supervisors has filed a lawsuit against the U.S. Postal service on the behalf of nearly 50,000 managers, supervisors, postmasters and other professional and administrative employees who the group says are owed back pay.

The lawsuit specifically represents Executive and Administrative Schedule employees, who are non-bargaining unit workers and operate under a pay-for-performance system.

According to the lawsuit, EAS pay is not comparable to that of the private sector and the pay-for-performance system is “seriously flawed,” which was confirmed by a fact-finding panel that reviewed pay packages from 2016 to 2019.

“…the Postal Service was and is violating the [Postal Reorganization Act of 1970] Act by inadequately compensating its EAS employees in a variety of manners, and that this inadequate compensation contributes to severe morale problems as well as problems with the attraction and retention of qualified supervisors and managers,” the lawsuit states that the panel concluded.

USPS rejected most of the panel’s findings.

“The USPS pay system for its managers and supervisors is broken and inconsistent with the expectations of the law,” said Brian J. Wagner, NAPS. “Given continued USPS resistance to the fair administration of the law, we have no choice but to seek the relief to which all supervisors, managers, and postmasters are entitled,” he added.

NAPS is seeking retroactive pay to compensate all EAS-covered employees at levels equal to comparable private sector positions from Oct. 1, 2015 (the start of the 2016-2019 pay package) to the date of a court’s final judgment in the matter.

The group also wants declaratory relief recognizing NAPS’s right to represent all headquarters and area EAS personnel and all postmasters who are members of NAPS.

30 years with the USPS. 27 years as a supervisor and I’m still $12000 from top level pay How is that fair?? This entire PFP system has been a sham from day one. Having raises not given even after meeting goals given. No raises for years. All this money will never be able to be made up no matter the outcome of this lawsuit. Ridiculous that we’ve complained about this since day one and nothing was ever done. Now look at the state of the PO! A joke. Can’t find anyone who wants to do this job anymore. Jobs being filled by people who just “don’t wanna carry” anymore. Micromanagement from a layer of district people who do nothing but send emails all day and have nothing else to do.

Come on. REALLY? You're talking about a group that work off the clock as SOP. Asking for raises when they don't even track their hours worked? These are the same employees that practice work hour theft on craft employees. No matter what happens, EAS not worth what they get paid. Never met one house inbred manager that didn't end up working in department store entry-level afterwards.

NAPS should also sue the USPS for the blatant unequal dirty treatment that occurred to EAS employees during 2010 thru 2015. EAS employees were not given pay raises during this time period in addition to that amounted to a pay decrease due to those employees having to pay an increased percentage share for their health insurance than previously paid.

Supervisory personnel and those serving the employer as augmentary Staff are part of management, yet, NAPS apparently wants to be the collective bargaining agent to represent those personnel before management. These personnel are either management or they are not. They did not - or under current labor law they shouldn't have had to - bargain for their perks and privileges, nor for pay, which is generally higher than that of the bargaining unit employee. What is wrong with this picture?

Wow. I just retired from USPS 5/2019. I was an EASTER headquarters field manager living in the San Francisco area. I felt we were under compensated compared to craft employees compensation. Their union is amazing.
