MSPB has only one of three members

The  U.S. Merit Systems Protection Board has only one member, according to the Public Employees for Environmental Responsibility, and the lack of a full a quorum has been preventing board from deciding on any appeals.

The MSPB is a three-member presidentially-appointed, Senate-confirmed panel that hears appeals of major personnel actions and complaints taken against or lodged by federal employees, but since January 7, 2017, the board has had only one member, causing the absence of a quorum, which prevents it from deciding any appeals.

“Through its inattention, the Trump White House has caused a merit system train-wreck in which whistleblower protections and other safeguards are functionally nullified,” PEER Senior Counsel Paula Dinerstein, said in a statement. “If justice delayed is justice denied, federal service is suffering an injustice epidemic,” she added.

As of May 10, 2018, MSPB had 1,111 cases awaiting a board vote, with some decisions pending since 2014. Of those, 216 are whistleblower cases, among hundreds of other cases involving discrimination complaints, terminations, adverse actions, and other personnel actions.

There are hundreds more cases in the pipeline being readied to join this ever-growing backlog, according to PEER.

Looks like a quorum returns to the MSPB as soon as next week after 23 months! HSGAC to approve all 3 nominees on November 28, 2018.

Trump administration botched the appointment by putting forward one appointee for Maunz’s term, if approved by the Senate, would begin March 1 and expire in 2025. Turns out that’s the continuation of Robbins’ term, meaning he would need to exit if Maunz enters.

President Trump has named MSPB Board replacements. It is the Senate's non-feasance in not confirming them that is holding up the process. Trump did his job.

This is how the management minions will destroy the rank and file hard working employees. Equal opportunity, work place issues, gender bias and the no fear act are all real problems that have been gutted. More reason the swamp of corrupt management minions need to be drained.
