I always appreciate you ...and all the others that have put up with a "frantic" me.
I'm at a point where I can embarrass alot of "important people" in court with how I got jacked in getting terminated,(Oosik, I had 4 seasonal positions before being terminated for the same job, at a new created GS-5 position) and as a veteran got jacked out of another job where procedures weren't followed to send me a "resondents right to reply"(CFR...something (?). when given a negative suitability paper. I hit these guys left ways to sideways(?)
So I asked that $50,000 would make me whole
$15,000 and the job I should have had(seasonal)w/ other supervisors
$5,000 and an apology from 5 "players" - I got wronged by, and I will write the apology scripts - in front of all my former workmates.
I just got an offer for $10,000.00 and go away.
Am I in the 98% losers and lucky? Is this a "first offer? I live w/or w/o them and have nothing to lose - Do I get perverse satisfaction of embarrassing questions, and go for more w/a judge and go for broke?? Or just get 30% tax off 10,000 and glad to get something?
From this zone w/you guys - Should I think I should celebrate that I have a response from these people? (It took a week). Are they showing weakness?
So I have no Judge appointed yet, but have met my deposition deadlines, no Judge to amend my charges to (to add on), the lawyer on the other end has real work to do........
I feel my stuff is strong.......and embarrassing.............Do I get greedy and ask for $20,000 ..or put my tail btwn my legs and go home........Any experience here? Help!

It is rare that I agree with Oosik, but I read his previous posting regarding your situation, and I agree with him. I would also like to add regarding your post above, that I find it incredible that you received a $10,000 offer from the agency and you are in a probationary status. You must have one heck of a case. Are you sure that you are giving us a full picture of your case? Could you add more details? Without more details, I could not begin to recommend whether you should accept it or not. I would like to state I am speaking for myself not Oosik. He may feel differently or have recommendations.

I was informed of my transgression of talking in a "sarcastic " tone of my voice on the radio to a security guard . This was presented to me 40 days after the fact and no proof - even though the statement said this was overheard by staff and visitors...at my "counseling session" about this they couldnt even say what I said or who accused me ...I found out 3 mos. after my termination.
I had a "heated argument" with a security guard in front of visitors when entering my complex with a bag.(No bags allowed) I am an employee, that for forever has a right - no questions asked.- been able to enter with a bag. This was my second day at work and if there was a rule changed - it changed while I was gone. The Guard (which I had negative history with) blew it up to where I cussed him out and he had witnessess with....he didnt, and I did, to prove him an idiot...but this was never investigated for me to show my side. I was judged wrong. I even got this admitted by the Superintendent, and Chief Law enforcement Officer, as bogus - yet it was used against me.
I had to yell at an unruly bunch of 7-year olds to restore order at a gravesite and 5 days later an e-mail comes to complain against me - and I am put on Admin Leave.....I write an informal grievance against this treatment.
I get a call 6 hrs later from my GS-11 that I can come back to work the next day.
I call in sick the day after this incident My GS-11 supervisor calls me, to tell me ,that I called in sick improperly and if I wanted to be a victim - then maybe I should consider other other employment...(hence grievance #2)
Another school group comes to my gravesite, unruly ,and I check their behaviour prior to entering ...and an e-mail complains that I am boderline "brusk and rude"....this was used to fire me 2 days before my first grievance was to be heard....and I had #3 grievanve about how lazy females were given a pass on performance - but others like me were held to a higher standard. She gets a recommendation to another Park - I get jacked on the tone of my voice on the radio that no one knows of. (and a myraid of other male/female discrepancies in the workplace)
I have witnesses to my facts. Background: This is new management brought in in the last part of my 4th season...that I got a bad vibe from ....and got re-hired later, after not being invited to my standard seasonal, as permanent, by being the top qualifier at the new GS-5 ..they reluctantly hired me.
I have witnesses, and what I overheard from third party, put out at a staff meeting, that the GS-11 Puertorican female has ,as her modus operandi ,that as far as tolerating rude behavior, at a gravesite, to all the white staff, that you cannot impose your "white values on visitors"
There's more - but thats the meat and potatoes. I was a probationary employee- hence no MSPB - but I had been there 4 ys. prior to this new management, coming in ,
and can show that I was the first of 5 white males in the division 1/12 ys ago to which there are zero today, also.
I also got screwed out of a maintenance position within the department (Vet preferance)for which I was the only qualifier for 2 days after I was terminated. They collaberated to squezee me out - the Maintenance Supervisor wanted me...but they put pressure on her...what I cant sweep floors effectively?....just a letter of unsuitability w/o a CFR right to respond....
Anywhoo....there's more ....my wife says take the $ and shutup!
Its all stomach-turning

Mick, If they offered you $10k for a case that a prelaw student in college could win - take the offer and then file a whistleblowing complaint against your agency for waste and fraud for inappropriate settlement of your complaint.
Based on your own description above I wonder why it took them so long to terminate you.

Dear officer Oosik, I am glad to see you are on complainant side. I want to ask you a little bit question: Could you tell me why agency settled me and asked me to waive appeal OSC rights? Do you think this is legal or not? Do you know what I am doing right now everyday? I wait for I will be die, I do not know when I am going to die. When my final day approaches, I can turn in agency SA to the news media and give to president. I want to show the darkness from federal government. I am not too brave to put family member's life on the knife. If you are really EEO officer, could you give me a little bit sunshine and warm my ?Thanks in advance. |

I know you are a lovely person.....but please value your life. These idiots in Federal government are simply not worth ending your life. Think of your children, your spouse, your extended family. Think of how truly precious life is. Watch the movie "The Road" or the "Book of Eli" - life is full of miracles.
I could have faced imprisonment for the agency's stupidity and false allegations. I trusted a Power greater than myself. I can laugh at the stupidity now and move on with my life.
There is a saying: "When God closes one door, he opens another. But as long as my fingers are in the closing door, they keep the new door from opening."
Close that door and push the new door open!

Breakheart, I read your statement to suggest that when you finally do pass along, you will then disclose the things that you believe were unfair to you. To answer your question was it fair for you to waive your rights to complain to OSC to settle your complaint -- Absolutely. You don't have to agree to a settlement if you don't like the terms. However, an agency rep would not be doing their job if they simply resolved one complaint while still having to litigate the same matters in a different forum. Global settlements are well accepted and widely used.

I was shaking my hands to sign that SA. If I do not sign, my family members would or will face what kind of life? Agency Attn. had contacted with my child- minor. Do you know how I felt? I can not speak out! I really can not speak out!! Recently, I got information from my friend who still has some relationship with my agency. She told me that my second line supervisor fired his assistant who worked for agency about 20 years. She is Africa American. Next, this my previous second line supervisor got force to resign( Hearsay). .....However, my first line supervisor got promotion. I really do not know what cycle is.
